2-Storey Rear Extension on a Slope

We are considering having a 2-storey rear extension built. Our house is on a slope, so the upper floor of the extension will attach to what is currently the ground floor, with the lower floor of the extension underneath. Our builder thinks that we can extend to 4m under permitted development as our neighbours have already done the same thing, whereas we think permitted development is 3m and what the neighbours have done is irrelevant.

Did you ever get planning through for this. We are just at pre planning now for the same thing, but bigger because permitted does not apply.
