Badly Fitted Windows With one Having 50mm Gap at the Top

Hi, I had some windows fitted by a friend none of which I'm happy with but the living room window is my biggest concern. It looks to me like he has measured up wrong as there is a 50mm gap at the top. He says expanding foam will sort out any insulation issues. The window wobbles terribly and is only held in by 2 screws thru the gap (pic attached) he says this is normal for a window 1.5m high x 2.35m wide. Am I being too fussy here?
Any input would be appreciated as he is coming round later with his can of magic foam.
