hot water tank thermostat removal

Hi
We use our gas heating to heat our water during winter but now summer has arrived we decided to use our electric emersion heater instead. As we both work it will only need to be on once a day for an hour or two. Heres the problem when i put it on it would not stop heating and the water came out like steam, i thought it must be the thermostat so tried to replace it. The COWBOY who fitted the boiles has placed the heating element right under the top feeder pipe so i cannot extract the old thermostat. As the element is on the top of our boiler could i remove it without draining the boiler ? hopefully i will be able to move the element once un screwed enough to take the thermostat out.
any advice would be greatly appreciated
