Replacement Oil Tanks and OFTEC Regulations

Hi All

I've recently found a slight leak on my heating oil tank and have found a bunded replacement that is the exact same dimensions as the old tank so will fit perfectly, however I have been told the new tank needs to comply with new regs despite it being a replacement.

Problem is I will lose a big chunk of garden to comply, lose a lot of my rear decking and have to move the garden gate & hence rebuild the wall to comply with this. I simply can't afford to do £4,000 worth of ground works & rebuilds to fit a £1,200 tank that would fit straight on.

Any advice? Do I have any rights? I haven't seen a single tank that complies with the regs in my village, but knowing my luck I'll be the one caught out.
