Surface Water Drain and Soakaway in Clay Soil?

Hi I live in a row of 4 houses that has one drain pipe from all 4 roofs that goes in to a surface water drain in my neighbours garden , so my question Is he is building a single story extension and he has had building control round and they told him to cap off the surface water drain and put a soakaway in his garden the garden is clay based is this normal practise or has building control gone mad ?
