Dry rot legalities

I have recently purchased a property which has dry rot. The problem is that next door has it too.
Obviously the damp poofing contractors cant guarantee the work unless both properties are done!
What are the legalities with this? The neighbour only gutted his 6years back and probly have to again. Can he claim from myself? If I have the work done does he also have to have his sorted legally?
Please help.
